By submitting an order, you agree to all policies described below. All orders that violate our policies will be canceled.

CONSUMER DATA PRIVACY
We respect your privacy and are committed to protecting it. All credit/debit card numbers, billing information, shipping information, and contact information in our checkout process are required in order to process and have the order delivered to the customer. We store some information for accounting and marketing purposes. Each transaction has a very high level of security. Credit/debit card information is handled through a secure SSL-encrypted connection by our payment provider who processes your transaction. No credit/debit card information is recorded or stored by us, and it can only be accessed by our payment provider.

SECURE TRANSMISSION
All information collected during the checkout process is transmitted via industry-standard Transport Layer Security (TLS). A Transport Layer Security (TLS) Certificate (or SSL Certificate) creates an encrypted connection between a Web site and a visitor's Web browser. Our online inventory changes continuously. Occasionally a product may appear on the site by mistake or the product may contain errors.
Many of our products contain photos that are provided by their respective manufacturers, distributors, or wholesalers. We can not guarantee they will match the physical product exactly. For specific features, info, and included accessories, please read the product descriptions, and do not rely solely upon the product photos.
We do not guarantee that titles, pictures, descriptions, or prices on our site are error-free. By placing an order, the customer agrees that Utah FAST will be the final arbiter of discrepancies in the online catalog, and Utah FAST reserves the right to cancel any order due to these errors. If an error is discovered we will correct the error and work with the customer to resolve the situation.

GENERAL FIREARM SALES
- Customers must meet the legal age requirement of your state of residence to purchase any firearm.
- Customers must be at least 18 years of age to purchase rifles or shotguns.
- Customers must be at least 21 years of age to purchase handguns, receivers, frames, NFA firearms (silencers, machine guns, etc.), or pistol-grip-only firearms.
- The transferee/buyer must be the purchaser of the firearm on the order/invoice. If the individual attempting to transfer the firearm or complete the Firearms Transaction Record (ATF 4473) is someone other than the individual who purchased the firearm, the dealer WILL NOT complete the transfer.
- If a firearm is listed as “Available In-Store” it means we have it in stock at our location available for pickup after the completion of the firearm transfer.
- If the firearm is listed as “Ships from our warehouse for local pickup or have it shipped” it means the firearm is not physically at our location and must be shipped from the manufacturer, wholesaler, or distributor to us for pickup after the completion of the firearm transfer. Customers also have the option during checkout to have the firearm shipped to a Federal Firearms License (FFL) dealer of their choice where the possession of the firearm can occur after completing the firearm transfer.
- All firearms, frames, receivers, magazines, firearm parts and accessories, and restricted law enforcement items are sold and shipped in accordance with all existing federal, state, county, city, and local laws and regulations. Many of the firearms, magazines, and parts for sale on this website may be restricted or prohibited in your area.
- All new firearms are shipped in their original manufacturer's box/container.
- Firearms requiring warranty work must be returned to the manufacturer within their current timeframes. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package unless we have guaranteed the entire package in writing. Contact the original manufacturer for warranty information on all accessories and special order items.
- Handguns will only be transferred to residents of the state where the transfer is taking place. Under certain circumstances, rifles and shotguns may be transferred to a non-resident subject to all state, county, city, and local laws. If you are uncertain, please consult the firearm laws of the state where the receiving dealer is located as well as your home state, county, and city.
Exceptions: Military personnel stationed in a state other than their legal residence may purchase firearms across state lines. Contact your local FFL receiving the transfer as you may have to provide proof of deployment, residence, etc.
- It is the customer's responsibility to check all federal, state, county, city, and local laws BEFORE placing an order.
- All National Firearms Act (NFA) rules apply for silencers, Short-Barreled Rifles (SBR), etc.

USED FIREARMS
All used firearms are sold “as is” and not eligible to be returned. Some manufacturers will honor warranties even if you are not the original owner. Please contact the original manufacturer for all warranty information requests on used firearms. Description and photos (if available) are provided by the seller and are based on actual items being offered for sale. Items being sold in this manner will be marked as such.

TRANSFER FEES
Many FFL dealers charge a transfer fee that is generally between $10 and $100. Utah FAST has no control over the fees any other dealer charges, nor do we know what fee they will charge. This fee may be determined by your state, county, city, and local laws and/or FFL dealer. This is NOT collected by our website but will be required to be paid at the time of the firearm transfer. Contact your local FFL dealer to inquire about any applicable transfer fees prior to placing your order.
- All handguns, rifles, and shotguns purchased from our website and the transfer completed at our location, are exempt from paying our transfer fee. This exemption does not apply to shipping costs or NFA firearm transfers which require additional time, paperwork, and waiting period.

BACKGROUND CHECKS
A background check which is generally completed through the National Instant Criminal Background Check System (NICS) or state agency if the customer lives in a Point Of Contact (POC) state, must be completed before a firearm transfer can be completed. This fee may be determined by your state, county, city, and local laws and/or FFL dealer. This is NOT collected by our website but will be required to be paid at the time of the firearm transfer. Contact your local FFL dealer to inquire about any applicable background check fees prior to placing your order.
For firearm transfers completed in Utah, background checks are conducted through the Bureau of Criminal Identification (BCI). We are required to collect the background check fee per U.C.A. § 76-10-526.12(a)(i), which states "All dealers shall collect a criminal history background check fee which is $7.50." Utah residents who provide the FFL dealer with a Utah concealed firearm permit at the time the firearm is transferred, and it is verified valid by BCI, are exempt from paying this fee.

AMMUNITION PURCHASES
- Customers must be at least 18 years of age to purchase ammunition used in a rifle or shotgun.
- Customers must be at least 21 years of age to purchase ammunition used in a handgun.
- All ammunition will be shipped via Fed Ex Ground or UPS Ground with an adult signature required. Expedited shipping on ammunition is not available.
- All ammunition functionality issues must be addressed by the manufacturer.
- Additional restrictions and/or state, county, city, and local laws may apply such as obtaining a permit/license prior to being able to purchase ammunition, requiring a background check to be completed, only shipping to an FFL, etc.

ORDER FULFILLMENT
- Please follow all directions prompted to you at checkout. This will ensure speedier delivery. Please note that the FFL selection on our website is for customer convenience only and does not necessarily mean that Utah FAST has the dealer FFL selected on file. If a customer wishes to change the FFL they want to use after the order has shipped, they will be additionally charged for the cost of shipping. If an FFL is not available at the time of delivery, the package will not be held at the carrier hub and will be returned to Utah FAST. Additional shipping charges will apply to orders that need to be re-shipped.
- Orders are processed as they are received. Items that are in stock at our location are shipped within 3 to 5 business days.
- In addition to our processing times, orders that contain products that will be shipped to us for pickup, and orders submitted to a wholesaler or distributor to be shipped to an FFL or drop-shipped directly to a customer are subject to the current processing, fulfillment, and shipping times which are generally 5 to 14 business days.
- Tracking numbers are provided when available.

ORDER RESTRICTIONS
- We only ship firearms to valid FFL Dealers. Firearms cannot be shipped to a P.O. Box. It is illegal to ship firearms directly to a customer's residence or to anyone who does not have a valid Federal Firearms License (FFL). For that reason, firearms purchased online may be picked up at our store or shipped to an FFL dealer of the customer's choice. We may contact and verify the FFL selected during checkout before we ship the firearm(s).
- Ammunition, and third-party items (Drop Shipped) will not be shipped to a P.O. Box.
- We will not make any changes to orders to meet the legal requirements of the customer's state, county, city, and/or local laws. Orders that contain any restricted product(s) will not have the product(s) shipped with the order. Firearms that include magazines that are considered "high capacity" that would violate the customer's state laws will be removed. Example: A Glock 19 has 15 round magazines and would not be shipped to California (or other prohibited state). Discounts or refunds will not be provided if restricted items are withheld from shipment.
- It is the customer's responsibility to check all federal, state, county, city, and local laws BEFORE placing an order.
- Magazine Ordering Restrictions
- Utah FAST abides by all state regulations regarding the sale of high capacity magazines. We DO NOT ship high-capacity magazines with firearms to the states that have active magazine restrictions. We WILL NOT replace high capacity magazines with state compliant magazines. We DO NOT offer refunds in place of the magazines.
- Magazine Restriction Exceptions
- Law enforcement officers (LEO) must provide both their credentials and a letterhead signed by their department's superior officer stating that the magazine will only be used in the execution of the LEO's duties. Utah FAST only recognizes City Police Officers, County Sheriff Deputies, and State Police (including Highway Patrol) as LEO.’s.
- Some of the states listed above may not have LEO exemptions. Please contact us BEFORE placing your order.
- Ammunition Ordering Restrictions
- Utah FAST abides by all state regulations regarding the sale of ammunition.
- You agree and accept all policies described in our Terms of Use.
- You are at least 21 years of age (for handgun ammunition) or 18 years of age (for rifle ammunition).
- By purchasing ammunition, you are not violating any local, state, or federal laws.
- You have not been convicted of any felony, a misdemeanor of domestic abuse, and you are not chemically dependent.
- You have no legal restraint that would prohibit you from possessing, ordering, owning, or transferring ammunition.
- You have never been committed to any mental institution, or been adjudicated as mentally defective. You will not sell ammunition to any minor.
Residents of Illinois, New Jersey and Connecticut must send in a copy of their FOID/FID/Permit. The customer is responsible to know and follow all federal, state, and local guidelines when purchasing and reloading ammunition.
Residents of Rhode Island, When ordering ammunition, you must be 21 years of age or older and must have a Pistol/Revolver Safety Certificate from the Department of Environmental Management. Please send a copy in along with your state ID for verification.
- Flamethower Restrictions
- No shipping to Alaska, Hawaii, California (model currently for sale), Maryland, and the city of Warren, Michigan.
Flamethrower ownership is generally legal in the United States without requiring any sort of background check. This is America, and freedom is something we stand for.
As the product name states, it is simply a long range torch. However, Maryland and California do have restrictions regarding such devices. The city of Warren, Michigan also prohibits possession via local ordinance.
In Maryland, flamethrowers are outright prohibited to possess due to falling under the state’s definition of a destructive device (not the federal definition).
In California, non-stationary devices that are designed/intended to emit a burning stream at least 10 feet are prohibited without a license issued by the State Fire Marshal. We’ve developed a nozzle that reduces the output distance to less than 10 feet to create a compliant version (PF-CA) that will be available soon. Nozzles are replaceable and available in our store for those out-of-state trips or transfer to a new owner.
Check with your local laws. It is your responsibility to understand and adhere to all relevant regulations.
The model we’re offering online is not compliant with California laws.

- Shipping costs vary due to the product(s) being purchased. Firearms, ammunition, and other merchandise cannot be shipped together. If a customer purchases these items, on the same order, they will be shipped separately which will require additional shipping costs.

SHIPPING SPEEDS
- Shipping speed varies depending on the carrier.
- Standard shipping on small accessory orders: Most smaller packages are shipped USPS Priority (2-3 business days in transit).
- Standard shipping on large accessory orders or ammunition: Most of these orders will ship FedEx Ground (on average, 2-4 business days in transit). Examples of orders that fall into this category would be 100 AR-15 magazines, any ammunition orders, torso-sized zombie targets, etc.
- Standard shipping on small firearm orders: Most small firearm packages are shipped USPS Priority (2-3 business days in transit). Examples of such packages would be a Glock 43, Canik TP9 pistol, HK VP9, etc.
- Standard shipping on large firearms: Most of these orders will ship FedEx Ground (on average, 2-4 business days in transit). Examples of orders that fall into this category would be an AR-15, AK-47, Bolt-action rifles, shotguns, etc.
- Once provided to the shipping carrier orders cannot be guaranteed to be delivered within that time.
- For orders that contain a firearm, tracking (if available) only indicates when the package has been received by us or by the FFL dealer, NOT when it is ready for pickup. To avoid unnecessary waiting, the customer must allow us or the receiving FFL dealer a minimum of 24 to 48 hours after the firearm has been received to complete the legally required acquisition process.

SHIPPING RESTRICTIONS
- Orders that contain a firearm, ammunition, and/or other products will be shipped separately and will incur multiple shipping fees.
- In compliance with federal, state, county, city, and local laws we will not ship firearms or restricted products to the location listed above in our “STATE SALES RESTRICTIONS”.
- In compliance with federal laws and the International Traffic in Arms Regulation (ITAR), firearms and other restricted products will not be shipped outside the United States.

P.O. BOX SHIPMENTS / RESTRICTIONS
Utah FAST abides by all Federal Regulations regarding hazardous material shipped through United States Postal Service. A hazardous material is any article or substance designated by the U.S. Department of Transportation as being capable of posing an unreasonable risk to health, safety, or property during transportation. This includes, but is not limited to:
- Minor Blast/Minor Projection Hazard — Ammunition
- Oxidizing Substances — Batteries
- Flammable Solids — Black Powder
- Flammable and combustible liquid — Cleaners, oil, and aerosol cans
If you wish to order any hazardous material, you must provide a physical address for shipment through UPS.

SHIPPING DELAYS
- Due to the influx of demand in our industry, orders may be delayed in processing due to becoming out of stock by our wholesalers/distributors before we are able to submit the order.
- For any questions please contact us but understand we are not always able to provide estimations on order shipment.

AMENDING ORDERS
No amendments or changes can take place once an order is placed.

CANCELLATIONS
- Orders can only be canceled if we have not submitted the order to a wholesaler/distributor to be fulfilled or if an “in stock” item has not been shipped.
- All cancellation requests must be made by email to utahfastllc@gmail.com. You MUST provide the order number.
- If the order has shipped it can not be cancelled and the customer must follow all rules applicable to returns. Please note that the return of the item/package will be made at the customer's expense.
- Cancelled orders may not be reversed. All cancellations are final.
- Company Cancellations
- In some cases Utah FAST may have to cancel an order or part of an order. Utah FAST will provide a refund or gift card for the amount of the order or part of the order that was cancelled.

RETURN REQUIREMENTS
- Products found defective after delivery to the customer must be returned within seven (7) calendar days.
- Products not found defective must be returned in the original condition, unused, unworn, and undamaged, with all product tags, wrapping, and packaging, and must include all accessories, manuals, documentation, and registration that shipped with the product, in a condition that allows resale to another customer.
- Firearms: VERY IMPORTANT!! Please take your time to inspect all firearms thoroughly before proceeding with the transfer. Once a firearm is transferred to the customer, it is considered used, even if un-fired. Firearms cannot be returned once it has been transferred into the customer's possession.
** Upon discovering a defect after the transfer, the firearm must be returned directly to the manufacturer for replacement or repair (in accordance with the manufacturer's warranty policy). By sending a defective firearm directly to the manufacturer, you can avoid the unnecessary transfer fees associated with returning the firearm to us through your local FFL dealer. Manufacturer-repaired firearms can be returned directly to the customer without additional FFL transfer or associated fees.
- All returned items will be subject to a 30% restocking fee.
- The customer will be responsible for paying all return shipping fees.
NOTE: We recommend using a carrier that offers shipment tracking for all returns, and insure your package for safe return or declare the full value of the shipment so that you are protected if the shipment is lost or damaged in transit. If you choose not to use a carrier that offers to track and insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.

REFUNDS
- All refund requests must be made by email to utahfastllc@gmail.com. You MUST provide the order number.
- Requests for a refund must be made by the customer who completed the order.
- Proof of original purchase must be provided which includes a receipt or order number, date of purchase, and name of the purchaser. If proof is not provided, we are under no obligation to provide a refund.
- Refunds will only include the product purchase price indicated on your order.
- Original shipping charges and return shipping charges are not refunded if the item is not found to be defective.
- Once we have received the returned item(s) and found it to be resellable we will process your refund, minus the 30% restocking fee, within 3 to 5 business days and credit in the same manner as we received the payment at the time of the order.

NON-RETURNABLE ITEMS:
Due to safety, legal, and regulatory reasons, our return policy does not apply to the following products.
Sales on the following products are final:
- Firearms (handguns, rifles, shotguns, frames, lower receivers, etc.)
- NFA Firearms (silencers, Short-Barreled Rifles (SBR), Short-Barreled Shotguns (SBS), machine guns, AOWs, etc.)
- Black-Powder Guns
- Illumination devices, electronic sights, optics, and night vision equipment
- Ammunition
- Casings
- Gunpowder
- Primers
- Special orders and products that are custom-configured to the customer's specifications (unless there is a defect or error on our part)
- Products sold "as is" or "used"
- Products that have been opened from the manufacturer's packaging
- Products that have been installed or used
- Consumables
- Downloadable Software/Products

PRODUCT AND FIREARM STORAGE
We are not a storage facility. We are a home-based business and do not have the space available to store items that have been purchased but have not been picked up. However, we understand that some situations and circumstances may not allow a customer to pick up an item purchased from us, or transferred to us, until a later date. Therefore we must charge a storage fee.
- There Are No Storage Fees For The First 14 Days (2 Weeks)
- Storage fees begin on the 15th day after the date the customer has been notified.*
- Storage fees are the same amount regardless of the product(s) or firearm(s) original purchase cost.
- Storage fees for NFA firearms are only calculated while waiting for the customer to schedule an appointment to complete the ATF Form 4, and after the ATF has returned the approved Form 4 with stamp tax. Storage fees for NFA firearms DO NOT apply during the ATF approval waiting period, regardless of the length of time.
- Scheduling an appointment does not stop storage fees from being assessed.*
- All fees must be paid prior to taking possession of the product(s) or firearm(s).
- A customer who refuses to pay the required storage fees will result in forfeiture.
- All items that have not been picked up by the customer within 60 days will be considered abandoned and will result in forfeiture regardless if the item was purchased from Utah FAST or if the item is a firearm it was transferred from another FFL or individual.
Storage Fees
- $1.00 per day from day 15 to day 30
- $5.00 per day from day 31 to day 60
* Example:
Day 0: Customer notified
Day 1: Customer schedules an appointment for pick up on day 17
Day 17: Customer picks up the item.
Fees Assessed: $3.00 (day 15, day 16, day 17)

LEGAL DISPUTES
These Terms and Conditions shall be governed by the laws of the State of South Carolina. By placing an online order with Palmetto State Armory, customer hereby:
- Submits to the exclusive jurisdiction of the federal or state courts located in Salt Lake County, Utah, in any litigation, suit, action or proceeding arising out of, or relating to, the order or these Terms and Conditions
- Knowingly, voluntarily, and irrevocably consents to the personal jurisdiction and venue of said court
- Waives any right to dismiss or transfer it may have based on improper venue or forum nonconveniens to the conduct of any proceeding in said court.
By placing an order through this website, customer agrees to HOLD HARMLESS AND INDEMNIFY Utah FAST for any and all costs, damages, or expenses (including reasonable attorney and other professional fees and disbursements) arising from any claim, cause of action, or legal dispute of any kind arising from or relating to the transaction or Utah FAST’s enforcement of these Terms and Conditions.

SEVERABILITY
If any provision of these Terms and Conditions shall to any extent be held invalid or unenforceable by a court of competent jurisdiction, then: (a) the remainder of the Terms and Conditions shall not be affected, and every remaining provision of the Terms and Conditions shall be valid and binding to the fullest extent permitted by law, and (b) a suitable and equitable provision shall be substituted for such invalid and unenforceable provision in order to carry out, so far as may be valid and enforceable, the intent and purpose of such invalid or unenforceable provision.

DESTINATION CONTROL STATEMENT
